Anti-Spam Policy

1. Definition of Spam
At Kroescontrol, we apply a clear principle:
Spam is consent, not content.
This means: any electronic message sent without prior consent from the recipient is spam, regardless of the content.
Examples
NOT spam (with consent):
- Marketing email to customer who gave opt-in
- Newsletter to registered subscribers
- Transactional emails (order confirmations, password resets)
- Follow-up email after explicit consent
IS spam (without consent):
- Cold emails to purchased email lists
- Bulk emails without opt-in
- Marketing to recipients who didn’t give consent
- Religious, political, or cultural mass emails without consent
It doesn’t matter:
- Whether the content is commercial, informational, or non-profit
- Whether the recipient might be interested
- Whether it’s “just once”
Without consent = spam.
2. Policy for Kroescontrol Customers
Kroescontrol prohibits sending spam through our services.
Prohibited Actions
As a user of our services, it is prohibited to:
- Send emails to persons who haven’t given consent
- Collect email addresses without consent (scraping, harvesting)
- Use misleading subject lines
- Hide your identity as sender
- Not offer an unsubscribe option
- Send bulk emails without opt-in
- Use our infrastructure for spam relay
Permitted Email Practices
With Explicit Consent
You MAY send emails if you have:
- Received opt-in via registration form with checkbox
- Used double opt-in (recommended)
- Written consent
- Proof of consent
Soft Opt-In (existing customers)
You MAY send emails to existing customers about:
- Similar products or services
- Provided: Clear opt-out in every email
- Provided: Within reasonable time after purchase/contact
Transactional Emails (always allowed)
These emails are NOT spam:
- Order confirmations
- Password resets
- Account notifications
- Invoices
- Support correspondence
3. Requirements for Legitimate Marketing Emails
Every marketing email must contain:

- No misleading “From” name

- Complete sender address
- As required by CAN-SPAM Act

- Functional and visible
- Works within 10 days
- No login required to unsubscribe

- As promised at opt-in

In case of violation of this spam policy, we take progressive measures:
1st Violation: Warning
- Email notification of violation
- Obligation to rectify within 48 hours
- Documentation of incident
2nd Violation: Temporary Suspension
- Suspension of email services (7-30 days)
- Mandatory spam training/documentation review
- Monitored probation period
3rd Violation: Termination
- Permanent termination of services
- No refund of costs
- Possible legal action for damages
Serious Violation: Immediate Termination
For very serious violations (e.g., large-scale spam operation):
- Immediate termination of all services
- Report to authorities (ACM, Police)
- Damage claim for reputational harm
- Publication in abuse databases
5. Reporting Spam
As Spam Recipient
Have you received spam from a Kroescontrol customer?
Email: abuse@kroescontrol.nl
Include:
- Forward of the spam email (with full headers!)
- Proof that you didn’t give consent
- Your contact details for follow-up
Response time: Within 24 hours
Process After Report
- Review (48 hours): Validation of your report
- Investigation (5 business days): Investigation with our customer
- Action (10 business days): Measures if justified
- Feedback: You receive feedback about the result

6. Monitoring & Enforcement
Proactive Monitoring
Kroescontrol actively monitors:
- Outgoing email volumes (abnormal peaks)
- Spam complaints via feedback loops
- Blacklist status (Spamhaus, SpamCop)
- Delivery rates (bounces, blocks)
Automatic Action
Upon detection of spam activity:
- ⚠️ Immediate suspension of sending
- 📧 Notification to account owner
- 🔍 Obligation to rectify
- 📊 Reporting in compliance dashboard
Feedback Loops
We participate in feedback loops from:
- Gmail

This helps us detect and address spam quickly.
